I’m somewhat surprised that courts haven’t forbid this type of thing already. It’s just so obviously antithetical to how courts are supposed to function.

Blame the idiot judge that allowed this in the first place.

He not only allowed it, he thanked them for making it and said it was deeply moving 🙄

Someone should make an AI video of the judge gang banging a bunch of dogs and see how grateful he is for AI bullshit then.

Yeah this is the kind of shit judges need to tell juries to not consider.

Horcasitas’ lawyer, Kristen Reller, who filed the appeal, declined to comment.

Jessica Gattuso, an attorney for victims in the case, did not respond to a request for comment.

You know it’s getting spicy when both lawyers are dead silent about it.

Meanwhile, the judge was openly fuckin’ delighted by it, like some sort of child.

I’ve been thinking about updating my will to say something about this. Like I strictly forbid my use of my image and voice in any AI videos after my death. Not cuz I think it’ll stop anyone else but I just hope that it would stop my sister for making me say something horrid in like a memorial video or some shit. She would absolutely create a video about me saying I’m in a better place now or some shit like that.

Course I’m not leaving her anything anyway so I guess there’ll be no repercussions if she violates it…

Your estate could possibly sue her, for using your likeness. IANAL, IANYL.

Course I’m not leaving her anything anyway

Leave her a dollar that way she can’t say that she was forgotten or accidentally left out. But like the other person’s reply, pls know that ianal so I could be wrong on how that all works

Imagine being the judge that authorized this, how stupid you must feel right now

Honestly, this shit should justify removal from the office. What a joke, courts should be based on evidence, not manipulation by AI generated slop.

At the time of the sentencing, the judge who oversaw the case, Todd Lang, seemed to appreciate the use of AI.

“I loved that AI, thank you for that. As angry as you are, as justifiably angry as the family is, I heard the forgiveness,” Judge Lang said. “I feel that that was genuine.”

It was from the sister/family, so probably her victim impact statement after being found guilty but before sentencing. They can say anything they want, really. Kind of the family’s way of saying, “We hate you but he would forgive you, so we do too.” Just a really weird medium to do that with.

Of course if this was somehow used as evidence or was used before verdict, what the fuck. Though I can’t imagine a judge and a defence lawyer just letting that slide.

Yeesh. This is one of those stories where everybody sucks. The murderer sucks for the obvious reason, the judge and prosecution suck for allowing this, and even the victim’s sister/family that made this abomination (and I acknowledge, may well have been grieving and had good intentions) but Y U C K.

If anybody turns my corpse into a puppet, even solely to advocate FOR ME, I will come back to haunt them and download viruses on all their computers forever

But if you reanimate my corpse to terrorize my enemies, I will be forever grateful. Jam a pole up my ass and make me dance outside their windows.

But… Do we have to wait until you’re dead? How about if you’re sleeping really deep, like if someone had slipped some GHB in you?

All of you getting angry at the AI are justified; it’s morbid and too much. But seems none of you actually read the context in which it was used. The video from the victim’s family was about forgiveness, not attacking the murderer. If anything, I’d consider that it would make for a lighter sentence, which the defense should appreciate.

If he gets resentenced to a longer time I’m going to laugh.

How the heck do you cross examine that?

If you’d read the article, you’d see it was for an impact statement, not testimony.

Still utterly rancid.

Yeah. Swap out the ai slop for a Daffy Duck animated impact statement, and no one will take you seriously. But a slop animated photo of the victim and everyone is like “woooh thoughtful “

You know I hate the asshole is going to walk but that lawyer for the deceased really fucked up.

Comments from other communities

Funny though that the message was a call for forgiveness from the sister. 10 years isn’t that bad for second degree murder. Now he gets to redo victim impact statements with annoyed folks.

post it to !fuckcars@lemmy.world too

Please don’t; it’s a story about AI, not urbanism, and is better discussed here.

(I’m a mod of !fuckcars)

It’s a story about a justice system that’s biased against pedestrians and for car drivers. You being a mod there doesn’t mean that you’re qualified to all the dimensions of the car dominated civilization. You could narrow the domain of talking about these things, but you’re not inherently better at understanding the problems.

Pelkey’s sister, Stacey Wales, told the BBC last year the family had used voice recordings, videos and pictures to recreate him for the AI video.

“To Gabriel Horcasitas, the man who shot me, it is a shame we encountered each other that day in those circumstances,” said the AI version of Pelkey in court in 2025. “In another life, we probably could have been friends.”

“I believe in forgiveness, and a God who forgives. I always have and I still do,” the AI version of Pelkey - wearing a grey baseball cap - continued.

What a weird thing to do.

I think the fact that his family did it kind of changes the story a bit, like they knew he’d be the forgiving type.

That might be more important than the dystopian seeming AI usage. The family got together and put something together to try and prove he would have forgiven this person.

If the defendant did this, yeah it’d be insane

An Arizona road rage killer will be resentenced

So momentarily quashed

Looks like they tried to come down on the killer too hard, the victim’s family even knew he would have been more forgiving than that, so they’re resentencing with a lesser crime or something?

The headline is too clickbaity for sure.

My dear void, that is some sick shit.

Haw sweet, man-made horrors beyond my comprehension!

Judge Todd Lang of Arizona.
